The men are suspected of attempted murder, attempted aggravated assault, contagion from a traffic accident, gross negligence in traffic and aggravated drunk driving.

In order for a person under the age of 18 to be detained, it is required that the person risks falling back into crime, that there is a danger of escape or that the person risks destroying the investigation.

The prosecutor must also make an assessment of whether it is proportionate to detain a person under 18 years of age.

Bills could make it harder to detain suspects under 18

The government has also presented a proposal that will make it even more difficult to detain suspects under the age of 18.

In the Law Council’s referral “More efficient handling of arrests and reduced isolation” from 13 February, it is proposed that suspects under the age of 18 can only be detained for three months.

Suspects under the age of 18 must also be given “the right to stay with staff or someone else for at least four hours every day”.

The proposal also makes it more difficult to arrest people under the age of 18, which should only be done “if absolutely necessary, and should therefore be placed elsewhere as a starting point”.

In connection with the bill being submitted to the Riksdag in March, however, the Government emphasized that exceptions from the proposed time limits may be made in the case of serious crimes that can be linked to organized crime.

– To investigate crimes, it may be necessary to detain, and also that detention be combined with restrictions. This is especially true when the crime is part of organized or gang-related crime, said Mikael Damberg.

The government proposed that the bill should enter into force on 1 September this year, but the bill has not yet been approved by the Riksdag
